We hereby wish to inform you of how we handle and secure your personal data. This privacy statement applies to the collection and processing of personal data of (potential) visitors to (the website of) Holland Casino.

When you visit an establishment or its website, order or purchase Holland Casino's products or services or when you contact Holland Casino, Holland Casino will collect personal data from you. The collection of your personal data is essential to enable us to offer you our services. We may also use your personal data to personalise and improve your experience with our services and/or products and to provide you with information from time to time.

Why do we collect your data?

Holland Casino collects your personal data insofar as this is necessary for a predetermined purpose, such as:

  • to facilitate your access to and stay at the establishments of Holland Casino; 

  • to offer you Holland Casino's products and services;

  • to conduct an effective security policy in the establishments of Holland Casino;

  • to combat gambling addiction;

  • to offer you the Holland Casino website;

  • to send you (where you have given your consent) our general e-mail newsletter or to keep you informed of Holland Casino's general promotions and offers;

  • to inform you (where you have given your permission) of specific Holland Casino products and services based on Holland Casino's known preferences;

  • to comply with Holland Casino's legal obligations;

  • to process your requests and enquiries and

  • to invite you (where you have given your consent) to participate in surveys relating to Holland Casino;

  • to contact you in response to your application;

  • to process your requests and questions about the application procedure.

What personal data do we collect from you and on what ground?

The grounds for processing your personal data by Holland Casino are different depending on our purpose. The grounds used by us are (see below for an overview of the data):

  1. a legal obligation;  

  2. your consent; 

  3. the performance of an agreement; 

  4. a legitimate interest. 

For guests, the execution of an agreement concerns the Favorites loyalty programme or holding an Xperience Card, for which we have entered into a contract with you. We ask for your preferences and name, address, place of residence, date of birth and e-mail address. Based on your gaming behaviour, we identify potential guests for different segments within the loyalty programme Favorites.

Your consent mainly concerns the commercial e-mail messages and mail we send to you. You can easily withdraw this consent by clicking the "unsubscribe" link in the e-mail or by contacting our Customer Service (see "5. Commercial communication", below).

The legal obligation mainly concerns the Games of Chance Act (WoK) and the Money Laundering and Terrorist Financing Act (Wwft) (see "6. Prevention policy and incidents" below).

In other cases, the basis for processing personal data is legitimate interest. For example, we make trend analyses within different groups of people and identify (game) needs within our target group. We use this to improve our services to you. Invoking the legitimate interest requires balancing the legitimate interests of Holland Casino against your interests as a data subject.

We process the personal data below based on our legal obligations to do so: 

  • Personal data: Name, date of birth, gender, country of residence, your contact details (such as address, place of residence, telephone number and e-mail address)

  • Persoonsgegevens: (Play) behaviour, payment behaviour, visit information including duration, frequency and history and any involvement in incidents

  • Personal data: Transaction data in case of cashless payments and bank transfers, including the IBAN.

Right to withdraw your consent
Where we require your consent to process your personal data, you have the right to withdraw your consent at any time. Among other things, you can withdraw your consent by choosing the "unsubscribe" option (newsletter), in any communication you receive from us. Should you wish to withdraw your consent in another way, section 15 describes how we will help you further with your request.

How do we collect personal data from you?

You can disclose personal data to us in various ways, for example when you:

  • visit an establishment of Holland Casino; 

  • visit the Holland Casino website; 

  • directly or indirectly purchase products or services from Holland Casino; 

  • participate in Holland Casino games; 

  • participate in actions, promotions, or competitions held by Holland Casino; 

  • come into contact with Holland Casino;

  • respond orally or in writing to a vacancy;

  • participate in a job application process, part of the job application process may be that we ask you to record a video;

  • use external parties or publicly available sources.

In that context, it is relevant that we pseudonymise and aggregate where possible and apply other principles of privacy by design. In addition, Holland Casino has a policy to monitor and continuously improve this. The Data Protection Officer, Privacy Officer and our internal audit department monitor this. Furthermore, only a limited number of employees have access to your personal data and Holland Casino has secured your personal data properly.

Automated decision-making

Holland Casino does not make significant decisions based on automated decision-making. This means that the way in which we draw up a profile has no legal consequences with a significant impact on you. We do not use special personal data for marketing purposes. Holland Casino does make marketing profiles of guests, as this is necessary to optimise our business operations, make you better offers and provide better service. Among other things, it is necessary to be able to assess whether a guest qualifies for a different or higher level in the loyalty programme Favorites. This involves automatic analysis of data from our own (CRM) systems to predict which persons are interested in certain products or services. 
We have set up our systems to fairly and accurately ensure the accuracy of personal data. The Privacy Officer has conducted a Data Protection Impact Assessment (DPIA) on our method of profiling. When processing your personal data, we apply the principles of privacy by design and privacy by default.

Commercial communication by Holland Casino

Holland Casino likes to get in touch with you about its products and services, for example by e-mail, post, SMS, telephone or other communication channels. You always have the possibility to unsubscribe and stop receiving further commercial communication from us by using one of the following options: 

  • by clicking on the 'unsubscribe' link at the bottom of emails sent by Holland Casino; 

  • by indicating via the contact form on the Holland Casino website that you no longer wish to receive commercial communications from Holland Casino; 

  • by writing to our Customer Services department at the postal address below or by using the contact form on hollandcasino.nl

When you unsubscribe from receiving commercial communications we will remove you from the mailing list as soon as possible. Normally within 1-3 working days. Due to processing time and production schedules, you may still receive communications that were already in production one more time.

Prevention policy and incidents

Holland Casino pursues a prevention policy to combat gambling addiction. This is our social responsibility and our legal duty. For example, we monitor whether your visiting frequency does not become too high. Holland Casino guarantees safety in its casinos and the integrity of its organisation and the game. We do this on the basis of the Wwft, among other provisions. This may mean that if you are (or have been) involved in an incident we register this in our incident register. This is our social responsibility and legal duty.

Camera surveillance and recording of telephone conversations

Holland Casino makes use of camera surveillance in its establishments to guarantee the safety of its guests and employees based on its legitimate interest. These images are automatically deleted after 4 weeks, unless there is an incident, in which case the term is extended under strict conditions.

When you contact us by telephone, this telephone conversation may be recorded. We record these telephone calls for the benefit of Holland Casino's corporate security. Only a limited number of employees of the Compliance Department have access to the images and recordings and these data are properly secured.

Application process

In the application process, Holland casino uses 'Equalture' neuroscience games, these neuroscience games are aimed at making the application process as fair as possible. And precisely to ensure that every candidate gets the same chance to showcase his/her talents. The aim of these neuroscience games is to form a picture of an applicant's knowledge and skills and how those skills might translate to Holland Casino's internal needs. Before you take part in one of these neuroscience games, we will ask for your permission to process your data and to share it with Equalture. Our recruiters will treat your application personally and with care.

Screening

Screening always takes place. We have outsourced the screening of new colleagues to an external organisation, Validata. The level at which you are screened depends on the position you will take up.

Cookie policy

When you visit the Holland Casino website, Holland Casino uses so-called "cookies" to facilitate your visit. Cookies are small text files which are stored on the hard drive or in the memory of your computer. Holland Casino uses cookies to record the preferences you have set for a particular service or web page so that you do not have to enter them again the next time you visit our site. In addition, cookies allow us to remember the products or services you buy when you use an online shopping cart.

How do we protect your personal data?

Holland Casino has taken appropriate technical and organisational measures to protect your personal data against loss and against any form of unlawful processing. We protect your personal data in various ways, including secure storage. Our information security policy is based on the standards of ISO 27001 and contains provisions on the organisation of the security of personal data, such as assigning responsibilities to functions, physical security, access management, employee authorisations, maintenance and development of systems, emergencies, monitoring and periodic security testing of systems (penetration testing) by an external party.

With whom do we share your personal data?

We only share your personal data with third parties if this is necessary within the framework of offering our services. This may, for example, be the case within the framework of executing an agreement or sending marketing messages.

With third parties that process personal data on our behalf (processors), we enter into a processor agreement that meets all the requirements of the AVG.

Some of our suppliers or third parties we work with are located in a country outside the EEA or store data outside the EEA With these parties we contractually lay down in processor agreements that privacy is guaranteed in a similar way as within the EEA, such as with the EU Model Contract Clauses. Furthermore, we may provide your personal data to third parties to comply with laws and regulations or in the context of legal proceedings, a court order or other subpoena.

Retention periods

Holland Casino will not retain your personal data longer than necessary for the purpose of processing. We keep marketing-related personal data for 2 years after your last contact with us. Data which Holland Casino must collect within the framework of the WoK and Wwft we keep for 5 years. Invoices we keep for 7 years pursuant to tax legislation.

Who is responsible for your data processing?

Holland Casino is responsible for the processing of personal data of its guests and employees. Holland Casino is registered in the trade register under number 68662289, and is located in Hoofddorp (2132 JP) at Neptunusstraat 71. Holland Casino's correspondence address is PO Box 355, 2130 AJ, Hoofddorp.

Your rights

You may at any time request Holland Casino to inspect the personal data Holland Casino is processing about you. You have the right to correct, supplement or have these removed. Holland Casino will comply with such requests to the extent permitted by law. You must submit a request for inspection and/or correction in writing. You must also enclose a copy of your proof of identity. This must be done via the secure KopieID app of the Dutch government.
